NAR Files Amicus Brief Opposing Massachusetts Statewide Rent Control Ballot Measure

The National Association of REALTORS (NAR) has joined other housing and industry groups in filing an amicus brief opposing a proposed November 2026 ballot measure in Massachusetts that would establish mandatory statewide rent control.

An amicus curiae ("friend of the court") brief is a legal document filed by a non-party with a strong interest in a case, providing information, expertise, or perspective to guide a court’s decision. These briefs, often filed by industry groups or experts, help courts understand the broader impacts of a ruling

This ballot measure would repeal the Massachusetts Rent Control Prohibition Act of 1994 and replace it with a strict, uniform rent control system with limited exemptions. NAR argues the proposal lacks protections for housing providers, such as ensuring a fair income, covering rising operating costs, or allowing relief in hardship situations.
The Massachusetts Association of REALTORS®  is leading advocacy efforts against the measure.
